Benchmark Guide To Museum Copyright And Trademark Issues Published

The International Intellectual Property Institute (IIPI) is pleased to announce that on November 5, 1999 the Pew Charitable Trusts, the American Association of Museums (AAM), and the J. Paul Getty Trust released a new handbook on intellectual property and trademark law for museums. Dr. Michael S. Shapiro, Secretary and General Counsel of IIPI, served as Senior Legal Advisor and Co-author for the project.

Underwritten by a major grant from The Pew Charitable Trusts, A Museum Guide to Copyright and Trademark addresses a broad range of issues related to museum collections, exhibits, fair use and the digital environment. The Guide was developed with the help of focus groups of museum professionals as well as examples and comments solicited from the museum field. Its content and direction was steered by both museum professionals and a legal advisory team.

“The publication of this benchmark guide comes at a critical time for the world museum community,” states Bruce A. Lehman, President and CEO of IIPI and former Assistant U.S. Secretary of Commerce and Commissioner of Patents and Trademarks. “As museums around the globe encounter complex intellectual property problems in the digital environment, this publication will be an invaluable resource.” IIPI is a nonprofit, nonpartisan organization dedicated to improving intellectual property systems around the world, thereby fostering global creativity and serving as a catalyst for world economic growth.”

A Guide to Museum Copyright and Trademark is designed to provide a general understanding of legal principles as well as answer specific questions using actual and hypothetical examples.

Chapter 1 – addresses copyright law-what it is, its requirements, duration, limitations.
Chapter 2 – introduces trademark law-what it is, why it matters, how to use it.
Chapter 3 – deals with a wide range of licensing issues.
Chapter 4 – discusses intellectual property protection on the World Wide Web.
Chapter 5 – addresses international issues, including treaties and the role of WIPO.

The funding from The Pew Charitable Trusts will provide one complimentary copy of A Museum Guide to Copyright and Trademark to every museum in the United States. Additional copies will be available through the AAM Bookstore.
